MEETING REPORT


A.   FOREWORD          

1.     The Consultative Council of European Prosecutors (CCPE) met in Strasbourg on 24 and 25 November 2011, under the Presidency of Mr João Manuel DA SILVA MIGUEL (Portugal). The meeting was opened by Ms Marja RUOTANEN, Director, Justice and Human Dignity Directorate. The agenda and the list of participants are appended to the present report.

B.   ITEMS SUBMITTED TO THE COMMITTEE OF MINISTERS FOR DECISION

2.     The CCPE invited the Committee of Ministers to:

a.     Take note of its Opinion No. 6 (2011) on the relationship between prosecutors and the prison administration,

and to transmit this document to the competent authorities in the member states and, where appropriate, having it translated into the corresponding languages, to transmit it also to the CEPEJ, the CDCJ, the CDPC and the CDDH to enable these bodies to take it into account in their work;

b.    take note of the present report as a whole.

C.   ITEMS SUBMITTED TO THE COMMITTEE OF MINISTERS FOR INFORMATION

The CCPE:

3.     decided to dedicate its Opinion in 2012 to the management of the means of the prosecution services and the Opinion in 2013 to the relations between prosecutors and media, in accordance with the terms of Reference of the CCPE adopted by the Committee of Ministers;

 

4.     appointed Ms Nelly HARUTYUNYAN (Armenia), Ms Alessandra GIRALDI (Denmark), Mr Olivier de BAYNAST (France), Mr Peter POLT (Hungary), Mr Harald RANGE (Germany), Ms Gabriela SCUTEA (Romania), Mr Antonio VERCHER NOGUERA (Spain), Mr Alexander ZVYAGINTSEV and Mr Vladimir ZIMIN (Russian Federation) and Ms Karen TOWNSEND (United Kingdom) as members of the CCPE-GT for 2012, and Mr Jean-Pierre DRENO (Monaco) and Ms Maria-Antonella BINO (Switzerland) as deputy members;

5.     instructed the CCPE-GT to prepare a draft Opinion on “the management of the means of the prosecution services” to be submitted to the 7th plenary meeting of the CCPE;

6.     agreed that the Opinion to be prepared in 2012 should be preceded by a questionnaire on the state of play regarding the management of the means of the prosecution services in the member states; replies to this questionnaire would serve as a basis for the preparation of the Opinion;

thanked Ms Gabriela SCUTEA (Romania) for taking the initiative to contribute to the elaboration of the questionnaire; entrusted the Secretariat to finalise the questionnaire and to send the questionnaire to all members of the CCPE by 15 December 2011; invited all members of the CCPE to submit their replies to the questionnaire in the course of January 2012 as well as to address to the Secretariat any information at their disposal relevant to the Opinion;

7.     re-elected Mr João Manuel DA SILVA MIGUEL (Portugal) President and Mr Antonio MURA (Italy) Vice-President of the CCPE for 2012; elected Mr Cedric VISART de BOCARME (Belgium) as member of the Bureau for 2012 and 2013;

8.     exchanged views regarding the opportunity to update Recommendation Rec(2000)19 on the role of public prosecution in the criminal justice system; invited the members of the CCPE to transmit their views on the possible updating of the different parts of the Recommendation Rec(2000)19 to the Secretariat; entrusted the Bureau and the Secretariat to prepare a synthesis of the views of the CCPE members for its next plenary meeting;

9.     took note of the state of work within the working group of the CDCJ entrusted with the preparation of  a draft Recommendation on the role of prosecutors outside the criminal law field and in which Mr João Manuel DA SILVA MIGUEL (Portugal), President of the CCPE, had been nominated scientific expert, and expressed the wish to have the possibilty to comment on the future draft Recommendation;

10.  proposed to hold its 7th plenary meeting on 26 and 27 November 2012 and the meetings of the working party (CCPE-GT) on 20 and 21 February and on 4 and 5 June 2012.
