CONSULTATIVE COUNCIL OF EUROPEAN PROSECUTORS (CCPE)

Abridged report of the 5th meeting (Yerevan, Armenia, 19 - 21 October 2010)

A. FOREWORD

1. The Consultative Council of European Prosecutors (CCPE) met in Yerevan, on the invitation of the Prosecutor General of Armenia, from 19 to 21 October 2010, under the Chairmanship of Mr Olivier de BAYNAST (France). The CCPE thanked the Armenian authorities, and in particular Mr Aghvan HOVSEPYAN, Prosecutor General, for the excellent welcome which the CCPE received as well as the quality of the organisation of the meeting. The agenda and the list of participants are appended.

B. ITEMS SUBMITTED TO THE COMMITTEE OF MINISTERS FOR DECISION

2. The CCPE invited the Committee of Ministers to:

      a. take note of the Opinion N°5 (2010) on "Public prosecution and juvenile justice", also called the Yerevan Declaration;

        and to transmit this document to the competent authorities in the member states and, where appropriate, having it translated into the corresponding languages and forwarding this Opinion to the Parliamentary Assembly of the Council of Europe;

      b. take note of the present report as a whole.

C. ITEMS SUBMITTED TO THE COMMITTEE OF MINISTERS FOR INFORMATION

The CCPE:

3. entrusted its Secretariat to forward the Opinion N°5 (2010) on "Public prosecution and juvenile justice" to the European Committee on Crime Problems (CDPC) so that it can be given the opportunity to comment on it;

4. invited its members to forward to the Secretariat written information on recent domestic developments regarding the prosecution service, which could be included in the area "country profiles" of its web site;

5. adopted the draft terms of reference of the CCPE for 2011, took note of the new adoption procedure of these terms of reference by the Committee of Ministers and expressed the wish that in the future, it would be possible to prepare, as in the past, terms of reference for two years, for a better organisation and planification of the work of the Council which has only one annual plenary meeting;

6. examine, with a view to the preparation of the Opinion No.6 (2011) of the CCPE and subject to the adoption of the terms of reference of the CCPE by the Committee of Ministers, a draft questionnaire on the relationship between prosecutors and prison administration, in particular in the light of the Recommendation Rec(2006) on the European prison rules, entrusted Mr Peter POLT (Hungary), who prepared the first draft, to modify it in the light of the discussions held during this meeting and keeping in mind that in some States, prosecutors are not competent in the field of prisons, entrusted then the Secretariat to send it to all member states by mid December 2010, in order to be answered before the end of January 2011;

7. appointed Nelly HARUTIUNYAN (Armenia), Josip CULE (Croatia), Alessandra GIRALDI (Denmark), Olivier de BAYNAST (France), Peter POLT (Hungary), Harald RANGE (Germany), Arend VAST (the Netherlands), Antonio VERCHER NOGUERA (Spain) and Alexander ZVYAGINTSEV and Vladimir ZIMIN (Russian Federation) as members of the CCPE-GT, and Jana ZEZULOVA (Czech Republic) and Ahmet TASYURT (Turkey) as deputy members;

8. instructed the CCPE-GT, subject to the adoption of the terms of reference of the CCPE by the Committee of Ministers, to prepare a draft Opinion on "the relationship between prosecutors and prison administration, in particular in the light of the Recommendation Rec(2006)2 on the European prison rules”, to be submitted to the 6th plenary meeting of the CCPE;

9. invited its members to continue the organisation of national events in order to promote the implementation of Recommendation Rec(2000)19 on the role of public prosecution in the criminal justice system for the tenth anniversary of this instrument and to inform the Secretariat as soon as possible so that this event can be supported by the CCPE according to appropriate modalities; to use this momentum to organise, where appropriate, the translation of this Recommendation into non official languages of the Council of Europe (it has already been translated into 14 non official languages);

10. elected Mr Joao Manuel da SILVA MIGUEL (Portugal) Chair and Mr Antonio MURA (Italy) Vice-Chair of the CCPE for 2011, re-elected Ms Raija TOIVIAINEN (Finland) member of the Bureau for a two year period and elected Mr Cédric VISART DE BOCARME (Belgium) member of the Bureau for 2011, in replacement of Mr Antonio MURA;

11. congratulated and thanked Mr Olivier de BAYNAST (France) for the excellent quality of the work done during his term of office as President of the CCPE;

1. thanked the Italian High Judicial Council (Consiglio Superiore della Magistratura) for its invitation to hold the 9th meeting of the CCPE-GT in the framework of a Conference organised at the occasion of the 10th anniversary of Recommendation Rec(2000)19 which will take place in Rome on 4 and 5th July 2011;

2. proposed to hold its 6th plenary meeting on 24 and 25 November 2011 and the meetings of the working party (CCPE-GT) on 17 and 18 March and on 4 and 5 July 2011.
