RAPPORT ABREGE DE REUNION

A.   AVANT-PROPOS   

1.     Le Conseil consultatif de juges européens (CCJE) a tenu sa 14ème réunion plénière à Strasbourg du 13 au 15 novembre 2013 sous la présidence de M. Gerhard REISSNER (Autriche). L’ordre du jour figure en annexe et la liste des participants est disponible auprès du Secrétariat.

B.   POINTS SOUMIS AU COMITE DES MINISTRES POUR DECISION

2.     Le CCJE invite le Comité des Ministres à:

a.     prendre note del’Avis N°16 (2013) sur « Les relations entre les juges et les avocats »

et noter que ce document sera transmis aux instances compétentes au sein des Etats membres, qui seront encouragés, le cas échéant, à en assurer la traduction dans les langues appropriées, ainsi qu’aux instances compétentes du Conseil de l’Europeafin qu’elles puissent en tenir compte dans le cadre de leurs propres travaux;

b.    prendre note deson rapport mis à jour sur la situation des systèmes judiciaires et des juges dans les Etats membres du Conseil de l’Europe ;

 

c.     adopter son mandat pour les années 2014 et 2015 ;

d.    prendre note du présent rapport dans son ensemble.

C.   LISTE DES POINTS DISCUTES ET DES DECISIONS PRISES PAR LE CCJE

Le CCJE

3.     adopte son Avis N°16 (2013) sur « Les relations entre les juges et les avocats » (CCJE(2013)4), sous réserve d’amendements possibles de forme qu’il charge son Bureau d’apporter le cas échéant, afin d’assurer la bonne cohérence des versions anglaise et française ;

 

décide de le soumettre au Comité des Ministres pour qu’il en prenne note; invite les Etats membres à en assurer une large diffusion auprès des décideurs publics, des juges et des avocats, y compris en en assurant la traduction le cas échéant ; décide de le transmettre également au CDCJ, au CDDH, à la CEPEJ et à la Commission de Venise afin qu’ils puissent en tenir compte dans le cadre de leurs travaux ; 

 

4.     remercie en particulier le CCBE, à qui il a récemment accordé le statut d’Observateur, pour sa contribution à la rédaction de cet Avis ; 

5.     adopte le rapport mis à jour sur la situation des systèmes judiciaires et des juges dans les Etats membres du Conseil de l’Europe (CCJE(2013)5), sous réserve d’amendements possibles de forme qu’il charge son Bureau d’apporter le cas échéant, et en prenant note des commentaires formulés par son membre au titre de la Grèce concernant la représentativité limitée de l’association de juges mentionnée au paragraphe 41, et par la délégation au titre de la Turquie indiquant qu’il n’est pas dans l’intention du gouvernement de proposer une législation telle que mentionnée au paragraphe 61 ;  

décide de le soumettre au Comité des Ministres pour qu’il en prenne note;

6.     rappelle que, conformément à son mandat, il est à la disposition du Comité des Ministres et des autres instances du Conseil de l’Europe (notamment le Secrétaire Général ou l’Assemblée parlementaire) pour rendre des avis concernant la situation spécifique des juges dans des Etats membres donnés ;

7.     prend note du Rapport d’activités 2013 (CCJE(2013)6) préparé par son Bureau et salue l’engagement de ses membres qui participent à la promotion des avis et des travaux du CCJE au cours de l’année dans le cadre d’autres fora ; 

8.     approuve son projet de mandat pour 2014-2015 lui demandant en particulier de préparer un avis sur « justice, évaluation et indépendance » et un avis sur « une justice ouverte et transparente – responsabilité du système judiciaire » et décide de la transmettre au Comité des Ministres pour adoption ;

9.     propose, pour un futur mandat, de retenir les thèmes de travail suivants : « les relations entre les juges et les pouvoirs législatif et exécutif » et « la mise en réseau de la justice » ;

10.  charge son Bureau de définir des modalités lui permettant de mesurer l’impact des Avis du CCJE dans les Etats membres ;

11.    nomme M. Orlando AFONSO (Portugal), M. José Francisco COBO SAENZ (Espagne), M. Nils ENGSTAD (Norvège), Mme Aida-Rodica POPA (Roumanie), M. Gerhard REISSNER (Autriche), M. Raffaele SABATO (Italie), M. Duro SESSA (Croatie), M. Jean-Claude WIWINIUS (Luxembourg), M. Osman Nesuh YILDIZ (Turquie) comme membres, et M. Alain LACABARATS (France) et Mme Katarzyna GONERA (Pologne) comme suppléants du Groupe restreint chargé de préparer le projet d'Avis sur « justice, évaluation et indépendance » (CCJE-GT) à soumettre à la 15e réunion plénière du CCJE;

 

12.  élit M. Bart van LIEROP (Pays-Bas) en qualité de Président et M. Richard AIKENS (Royaume-Uni) en qualité de Vice-Président pour l’année 2014; élit M. Johannes RIEDEL (Allemagne) comme membre du Bureau en remplacement de M. AIKENS pour l’année 2014;

13.  exprime sa grande reconnaissance à M. Gerhard REISSNER (Autriche) pour son action en qualité de Président du CCJE en 2012 et 2013 ;  

14.    désigne Mme Aida-Rodica POPA (Roumanie) comme rapporteur pour les questions de parité pour l’année 2014 ;

 

15.  propose de tenir sa 15ème réunion plénière du 22 au 24 octobre 2014 ; il remercie son membre au titre de la Turquie pour son invitation à tenir cette réunion à Istanbul ;

16.  propose de tenir les 26ème et 27ème réunions du groupe restreint (CCJE-GT) respectivement du 17 au 19 mars 2014 et du 23 au 26 juin 2014; il remercie son membre au titre de l’Allemagne pour son invitation à tenir la 27ème réunion à Berlin en la complétant par une rencontre avec la Commission scientifique sur l’auto-administration du système judiciaire.
